This website & e-commerce store are owned & managed by MAISON YEYA FZ L.L.C. hereinafter referred to as MAISON YEYA.
By accessing, registering, browsing and using the Site, and purchasing the goods available on the Site, You acknowledge that You have read, understood and agree to be bound by these Terms.
Because of the dynamic nature of the e-commerce, mobile devices and the internet, MAISON YEYA makes no promise, warrant or guarantee that its website will be uninterrupted, entirely error free, free of viruses, hacks, bugs or compatible with any other specific software or material. Accessing the website is at your own risk.
MAISON YEYA reserves the right to make changes, amend errors, remove or add any part of the website or to update product information at any time if considered necessary.
You must be over 18 (Eighteen) years old to use the MAISON YEYA Site and place orders through the site. The Site may be accessed from the UAE as well as from countries outside the UAE. MAISON YEYA does not guarantee the Site and the purchase of goods through the Site complies with the laws of a country other than the United Arab Emirates. You fully understand and agree that accessing the site from a country other than the UAE, you do so at your own risk and it is your responsibility to ensure that your access and use of the Site and/or purchase of goods through the Site complies with the laws of the country from where you use the Site and/or purchase goods through the Site.
- Order Acceptance
MAISON YEYA reserves the right to accept or reject, at its sole discretion, any Order for reasons including stock availability, ineligibility, unconfirmed payment or suspected fraud.
MAISON YEYA cannot guarantee that an item showing to be available on the Site is actually available due significant fluctuating of inventory. You will be duly notified should this happen. Placing items in the Site cart/basket does not necessarily mean that such items are reserved.
- Order Cancellation or Modification
Orders that have not been confirmed by MAISON YEYA can be cancelled, subject to the MAIOSN YEYA’s written agreement and subject to your indemnifying MAISON YEYA against all losses, costs, damages, charges or expenses that may be incurred by MAISON YEYA as a result of such cancellation.
If, after making the payment for an order that You placed through the Site You decide to cancel or modify the order, it is advisable that You do so as soon as possible, and through the option available online through the Site. Accordingly, if you cancel it within the specified time, MAISON YEYA will cancel the order and issue a full refund to your method of payment. If You wish to modify your order, we will do our best to apply the requested modification subject to stock availability and to any related price adjustments. If the order shows as “Processed”, You will have to receive and use the “Returns Process” as may be applicable and allowed.
Prices on the MAISON YEYA Website are displayed in US$, and exclude any services such as shipping and delivery, taxes, customs duties which may be applied. You will be informed of such additional charges when your order is completed and before check-out and payment.
MAISON YEYA does not accept Cash On delivery (COD), Bank Transfers or cheques as acceptable methods of payment. Payments are only accepted through VISA or MASTERDACRD credit or debit cards, in US$ (US Dollars). All credit or debit card payments are subject to authorization and validation by the card issuer at the time of payment. If the card issuer rejects a payment, MAISON YEYA will not be liable for any delay or non-delivery and also reserves the right to cancel Your order if needed.
By placing an order through the website, You represent and warrant to MAISON YEYA that payment details as provided on Your order are valid and correct and that payment will be made in full as soon as your order is accepted and processed.
- Shipping & Delivery
MAISON YEYA’s objective is to deliver your ordered items as fast and as accurately as possible, whether locally or internationally. This is usually achieved through our logistics partners who will provide you with information about your package status so that you can better track your delivery.
In certain cases, based on the ordered item(s) and the destination, some items may be shipped on a DDU (Delivery Duties Unpaid) basis. This means that the customer will be responsible to pay any duties and taxes that may be due in the country of destination. If, for any reason, you refuse to receive the delivery, or are unavailable or unable to take action despite reasonable attempts by our logistics partners, your ordered item will be returned to MAISON YEYA and you will be charged for the unpaid duties, taxes & any additional shipping charges that may be or have already been incurred.
Maison Yeya will NOT deal or provide any services or products to any of OFAC (Office of Foreign Assets Control) sanctions countries in accordance with the law of UAE.
- Damaged Goods/Incorrectly Fulfilled Orders
MAISON YEYA is always extremely thorough in quality control and in ensuring that all products are of high quality and finish and that orders are adequately and correctly fulfilled before they are delivered to our valued customers.
In the event you believe that your ordered goods are received with a manufacturing defect, please inform our Customer Care Department within 2 (Two) days from receiving the Order, at email@example.com quoting your Order No., so we can serve you and resolve the matter in the best and fastest way possible. In the meantime, please make sure that you maintain the item in question in the same condition that you received it (packaging, original Invoice, etc…). Our Customer Care Department will guide your though the required steps. Please refer to sectionReturns, Exchanges & Refunds Policy below.
- Returns, Exchanges & Refunds Policy
MAISON YEYA will only reimburse/refund items that are faulty, with a manufacturing defect or that were incorrectly supplied. Items with an incorrect size will be exchanged and cannot be refunded. An item that has been worn, altered or washed or that is not in its original packaging and tags, cannot be exchanged or returned. Items with any indication that they were used, will not be accepted.
Items that are returned due to a manufacturing defect or due to an incorrectly fulfilled order, have to be thoroughly inspected and checked. If, after inspection, it is decided that the returned damaged item will be replaced, then you will not be charged for any shipping charges. If the replacement item is not available in stock, we will issue a Credit Note in your favor that can be used on our Site at any time within 6 (six) months, or a refund will be processed and a credit will be applied to your method of payment with 30 (Thirty) days.
Items that are accepted for refund, will be refunded to the original mode of payment. Please note that shipping charges for items to be refunded are to the Customer’s responsibility.
In case of refund, refund will be done only through the Original Mode of Payment.
- Intellectual Property Rights
Unless otherwise expressly indicated herein, MAISON YEYA reserves ownership of all Intellectual Property (IP) rights used in the Website. Nothing in these Terms constitutes a transfer of any such rights.
Using the Website and its contents does not grant you any copyright, design, trademark or other IP rights relating to the Content as well as any software or other related coding used in the Website.
You are permitted to use the Content of the Website only as expressly authorized by us. Any reproduction or redistribution of any part of the Content is prohibited and may result in legal action. It is expressly prohibited to linking, copying or using any Content with a purpose to be commercially exploited on other servers, locations or as a support for publications, reproduction or distribution. You are however permitted to use it for the purposes of own personal viewing.
- Liability & Indemnity
MAISON YEYA is not liable to you for any loss or damage whatsoever caused or arising directly or indirectly, in connection with the website and terms, except to the extent that such liability cannot be lawfully excluded under United Arab Emirates consumer Law.
Liability is limited to our contractual obligations to supply the items you order using the website and following our acceptance of such orders. Neither we nor our employees, suppliers or other representatives will be liable to any loss or damage whatsoever in any way connected to your use of the website. Moreover, in no event shall we be liable to you for any business losses, special, indirect or consequential damages.
You agree fully to defend, indemnify and hold MAISON YEYA, its directors, agents, affiliates and suppliers, harmless from and against any and all claims, damages, costs and expenses, including legal fees, arising from or related to your use of the website and/or your breach of any representation , warranty, or other provision of the website terms, including the use by third parties accessing the website using your account caused by action or inaction.
You agree and acknowledge that the MAISON YEYA Terms constitute the complete and exclusive agreement concerning your use of the website and any purchase by you of any items through the website, and supersede and govern all prior proposals, agreements other communications.
Nothing contained in the MAISON YEYA website Terms shall be considered as creating an agency, partnership or other form of joint enterprise between us.
- No Warranties
MAISON YEYA makes no warranties of any kind whether expressed or implied, including warranties against viruses, worms, trojan horse or any other form of malicious programs. MAISON YEYA does not represent or warrant that the website is free from any defects. You agree that you are using and browsing the website at your own risk and that you assume full responsibility for any loss of use, loss of data that may be subjected to.
- Governing Law
All Terms related to the Website and related e-commerce shall be governed by the laws of the United Arab Emirates and the laws of the Emirate of Dubai. Any and all disputes arising out of, relating to or in connection with these terms, shall be referred to and are subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates. Any purchase, dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of UAE”
